CPD draft agreement (25.09.07)

1. Employees ineligible for CPD

The following employees are ineligible for CPD payments:

• FFs who are not competent, and/or who have not been in post 8 years as at 30.06.07, i.e. their start date is 02.07.99 or later, unless they have been promoted substantively in the meantime, and have been at the competent rate in their higher role at least since 01.07.06.

• Those at CM and above, who are either not substantive in role, or who were not at the competent rate, on 01.07.06 or before. (The exception to this is those who have been acting into their newly promoted role since 01.07.05 or before, even if substantive promotion has taken place since 01.07.06, see section 3 below. These employees will also be eligible.)

Employees ineligible for CPD do not have rights to appeal against ineligibility, and for CPD payments.

2. Employees eligible for CPD

All employees not in the above categories are eligible to be considered for a CPD payment.

Eligible employees, in year 1, will be paid CPD payments without having to complete an application form provided they are not subject to any of the three elements listed below. (An application form will however need to be completed by eligible employees who are subject to one or more of these elements).

• Employees with 9 days or more NDTS sickness in the period 01.07.06-30.06.07. This is in line with the requirement to achieve high levels of attendance.

• Employees who have been on Light Duties for 6 months or more of the period 01.07.06-30.06.07.

• Employees who have been absent from work on unpaid leave (e.g. career break; special leave) for 6 months or more of the period 01.07.06-30.06.07.

As stated above, employees who are not subject to any of the three elements listed above will be paid the CPD payments without having to complete an application form. Employees who are subject to one or more of the three elements listed above will need to submit an application form to be considered for a CPD payment. The application process is set out elsewhere.

3. CPD and acting up/temporary promotion

In accordance with the national agreement periods of acting/temporary promotion will not attract a CPD payment whilst carrying out the acting/temporary promotion except where the acting/temporary promotion is within role: e.g. WM A to WM B

In recognition of staff undertaking long term acting/temporary promotion, staff who have acted up or been temporarily promoted continuously since 01.07.05 and are otherwise eligible to receive a CPD payment shall be eligible to do so in the acting/temporary role.

N.B. The above does not apply for those in receipt of SRAs/ARAs. Those in receipt of SRAs/ARAs will continue to receive CPD if otherwise eligible.)
